Effective January 1, 2011, for both new and renewal business
Dear Willard, This notice is to advise you that Arbella has received approval for changes to our Homeowners, Dwelling Fire and Umbrella programs. These changes are being made as a result of an increase in weather-related losses that have affected many communities throughout Massachusetts over the past two years. These changes, which are for new and renewal business effective on and after January 1, 2011, include the following:
HOMEOWNERS AND DWELLING FIRE CHANGES
Homeowners and Dwelling Fire Base Rate ChangesFor HO3 polices, we are increasing our base rates, resulting in an overall effect of 5.2%. The increase varies by territory. For HO4 and HO6 policies, we are increasing our rates by a flat 4% and 5%, respectively. Dwelling Fire policies will receive a flat 6.5% base rate increase in all territories.
Homeowners and Dwelling Fire Personal Injury Endorsements
We are increasing the premium we charge for our existing Homeowners and Dwelling Fire Personal Injury Endorsements (HO 2482 and DL 2482) to $25. This change is being made as a result of an increase in exposure and resulting claims due to Internet, chatting and blogging website usage.
Homeowners and Dwelling Fire Changes to Our Special Provisions
We have added new language to our existing Homeowners (11AR 1266) and Dwelling Fire Special Provisions (14AR 1042 and 14AR 1044) that now obligates policyholders to advise us of any material changes that occur at their properties that may impact either their acceptability or the premium we charge. Failure to do so could result in our denying coverage for a future loss.
Changes to Our Special Coverage and Water Backup and Sump Discharge or Overflow Endorsements
We have increased the premium we charge for our Special Coverage Endorsement (11AR 1034) from 15% of the policy's base premium to 16%. We have also increased the premium we charge for our Water Backup and Sump Discharge or Overflow Endorsement (11AR 1278) from $75 to $95.
We have adjusted the water backup coverage language in each of these endorsements so that they are now consistent with each other. There is no impact to the coverage provided under these endorsements, as these changes were made for consistency purposes only. We have also added language to both endorsements that states that we specifically cover water overflow from French drains. This coverage has been provided in the past; however, we now clearly state that we do provide this coverage. Last, we have increased our water backup deductible on both endorsements from $250 to $500.
Homeowners and Dwelling Fire Advisory Notices
We will send new Homeowners (11AR 1283) and Dwelling Fire (14AR 1045) Advisory Notices to all renewal customers, advising policyholders of the changes we made to our Special Provisions and water backup coverage.
New Coverage Options for Secondary and Seasonal Homes
In order to provide more coverage options for your policyholders, we have made our Special Coverage Endorsement (11AR 1034) and our Additional Protection Package (11AR 1063) available for use with secondary and seasonal homes.
New Other Members of Your Household Endorsement
We are making ISO's Other Members of Your Household Endorsement (HO 0458) available for use. This endorsement provides personal liability, contents and additional living expense coverage to the person named in a schedule who lives with and is a member of the insured's household. We also provide coverage for a person under the age of 21 who lives with and is in the legal custody of the person named in the schedule. The person named in the schedule cannot be an insured, guest, residence employee, tenant, roomer or boarder. Our premium charge for this endorsement is $75.
UMBRELLA CHANGES
Our Stance on Resident Relatives
We have made changes to our policy language to now state that we no longer provide coverage for resident relatives when they are operating any auto furnished or available for their regular use other than vehicles owned by the named insured. This means that resident relatives are no longer covered by this policy when they operate their own vehicles. If a policyholder would like the Umbrella to provide this coverage, they now have the option of choosing to add our new Buyback Coverage for Resident Relatives Endorsement.
New Buyback Coverage for Resident Relatives Endorsement
Our new Buyback Coverage for Resident Relatives (12AR 1072) provides coverage under the Umbrella for any auto driven or owned by any relative as long as he or she is a resident of your household. There is no charge for this endorsement, but the resident relatives' autos must be insured with Arbella and must carry the 250/500/100 limits.
Dec Page Changes
We have added some language to our existing dec page that now states that coverage is not provided for risks that are specifically excluded under this policy. Along with this, item number three on the dec page, which states that we "insure all autos owned or leased by any relative resident in your household" will display on the dec page only if our new Buyback Coverage for Resident Relatives Endorsement is attached to the policy.
Personal Liability Umbrella Supplemental Application
The purpose of our Personal Liability Umbrella Supplemental Application (12AR 1073) is for the instance where the insured has a specific exposure that we would not cover under an Umbrella policy. In a case like this, we ask that you fill out the Personal Liability Umbrella Supplemental Application, listing the exposure that is excluded, and have the policyholder sign and initial the form. In signing this form, the insured confirms that he or she understands and agrees that there is no coverage for the exposures listed. The form then needs to be sent back to us for processing.
Personal Umbrella Policy Endorsement Coverage Exclusion
Our new Personal Umbrella Policy Endorsement Coverage Exclusion (12AR 1074) will be attached to policies listing the specifically excluded exposures that were listed on the Personal Liability Umbrella Supplemental Application.
New Rates for Out-of-State Autos and Homes
We are introducing new rates to be charged for out-of-state autos and homes that are listed on the policy. These rates are as follows:
Additional Out-of-State Auto Exposure with 100/300 Underlying $75
Additional Out-of-State Auto Exposure with 250/500 Underlying $65
Additional Out-of-State Owner-Occupied Residence $25
Additional Out-of-State Rental Unit $35
Our Stance on Personal Injury Coverage
In order to purchase an Umbrella policy through Arbella, we now require personal injury coverage to be on the underlying Homeowners policy. The majority of our in-force Umbrella policies already have underlying personal injury coverage in place. In order to help you identify the policies that do not, as stated in an earlier notice, we have added an indicator to the Umbrella renewal list that will denote each policy that does not have underlying personal injury coverage in place. We ask that you review this list and endorse the policies that do not have the coverage.
Material Changes Made to Your Policy
We have added language to our Personal Umbrella Policy (12AR 1042) advising policyholders that they must tell us of any changes that may have a material effect on their policy.

We are sending all of your renewal customers an Advisory Notice (12AR 1075), advising them about our stance on resident relatives and our requirement for them to notify us of any changes that may impact their acceptability or the premium we charge.
